HokuApps Privacy Policy

HokuApps Limited ("HokuApps") provides this policy with respect to privacy (“Privacy Policy”) as a guide to the nature of using the HokuApps Site and HokuApps Service. If you do not agree to this Privacy Policy, then you should not use the HokuApps Site or HokuApps Service. This Privacy Policy is as referenced in the HokuApps Terms of Service. Any capitalized terms used and not defined herein shall be defined as set forth in the HokuApps Terms of Service. If you provide any content to the HokuApps Site or HokuApps Service, such content shall be subject to this Privacy Policy and the Terms of Service; provided, however, this Privacy Policy does not apply to any entities not under the ownership or control of HokuApps or to individuals not employed or managed by HokuApps (e.g., any third party to which HokuApps may disclose user information as set forth in this Privacy Policy). Any Data Submissions or other information used in connection with the HokuApps Service becomes published content and is not considered personally identifiable information subject to this Privacy Policy.

1. Privacy Policy Changes

HokuApps may revise this Privacy Policy in its sole discretion. If any such changes are made, HokuApps will endeavor to notify you of any such changes (e.g., a general notification via the HokuApps Service to all users). If you disagree with any such modifications, then you can stop using the HokuApps Site and HokuApps Service pursuant to the Terms of Service.

2. The Information HokuApps Collects

In connection with the HokuApps Service, HokuApps may obtain the below information:

A. User Provided Information:

You will provide information to HokuApps, which may include your name, username, phone number, billing information and device information. The foregoing information may be provided in deciding to participate in various uses of the HokuApps Service (e.g., registering as a user, updating your data or requesting data for your contacts). If you provide any of the foregoing information regarding another user, then you must be authorized to submit such information on such individual’s behalf.

B. Content:

HokuApps may collect and store content in connection with the HokuApps Service (e.g., history, archiving, and compliance).

C. Cookies Information:

When you visit the HokuApps Site, HokuApps may send one or more cookies to your computer that uniquely identifies your browser.

D. Log File Information:

In connection with the HokuApps Service, HokuApps may log certain general information such as whenever a message is sent or received or with respect to your updates or requests for information, including time and date stamps and applicable phone numbers. In connection with the use of the HokuApps Site, HokuApps may record information when you visit a website via your web browser (e.g., your IP address, web search, the default language setting of the browser, the browser type, the last and next sequential URLs visited, the date and time of your request, nature of clicks, cookies that may uniquely identify your browser, applicable phone numbers, and other related information or data).

3. The Way HokuApps Uses Information

If you submit information to HokuApps through the HokuApps Site, or HokuApps Service, then HokuApps may use your personal information to run, maintain, and customize the HokuApps Site and HokuApps Service. Any information or Data Submissions that you voluntarily disclose on the HokuApps Service becomes available and may be collected and used by other users of the HokuApps Service. HokuApps may use your information (e.g., anonymous user usage data, cookies, IP addresses, browser type, and other information) to advance and customize the HokuApps Site and HokuApps Service including with new features and functionalities. HokuApps may use cookies and log file information to: (a) remember information (e.g., for purposes of your convenience in the use of the HokuApps Site); (b) customize content, information, and display; and (c) track relevant data metrics.

4. When HokuApps Discloses Information and Third Party Marketers

In the maintenance and improvement of the HokuApps Service, HokuApps may share your information with third party service providers. For purposes of assisting relevant third-parties with any advertisements, promotions or other third-party run functionalities in connection with the HokuApps Site, HokuApps may also share non-personally-identifiable information (e.g., anonymized data) with such third-parties. HokuApps may collect and release information in the good-faith belief that such action is necessary to comply with applicable laws (e.g., U.S. copyright law), including a court order, subpoena, or search warrant or equivalent, or if an individual’s safety may be at issue (as determined by HokuApps’ reasonable belief). HokuApps also may disclose such information in connection with government investigations and enforcement actions, to enforce the Terms of Service, to defend itself from third-party claims or otherwise limit its liability, to maintain the security of the HokuApps Site, and to otherwise protect the rights, property, and/or personal safety of HokuApps, users, or others. With respect to information and/or Data Submissions obtained in the delivery of the HokuApps Service (e.g., in accordance with Section 2 of this Privacy Policy), HokuApps, its affiliates, and assignees shall have an unrestricted right to use your information in concert with or as third party marketers both within and outside of the scope of the provision of the HokuApps Service.

5. Your Choices

You may decline to submit select information through the HokuApps Site or the HokuApps Service, and HokuApps may not be able to provide certain services to you. If you do not agree with the Privacy Policy or Terms of Service of HokuApps, you may delete your account, uninstall the HokuApps software and discontinue use of the HokuApps Service; if you continue to use the HokuApps Service, you are expressly agreeing to this Privacy Policy and Terms of Service via such use. Please contact HokuApps via the HokuApps Site with any questions or comments about this Privacy Policy and your information.

6. Transmission of Data

HokuApps uses commercially reasonable efforts to secure its systems. However, HokuApps cannot ensure the security of any information you transmit to HokuApps and you do so at your own risk, and you should not use unsecured internet access or other unprotected networks to submit messages through the HokuApps Service. If HokuApps learns of a security systems breach, then it may attempt to notify you electronically so that you can take appropriate protective steps (e.g., HokuApps may post a notice on the HokuApps Site or through the HokuApps Service if a security breach occurs).

7. Children’s Information

HokuApps Service is not directed to minors less than 16 years of age and minors less than 16 years of age may not use the HokuApps Service. Please contact HokuApps if you learn that a minor under 16 years of age has provided information to HokuApps.

8. International Hosting

The HokuApps Site and HokuApps Service are hosted in various countries. The use of the HokuApps Site and HokuApps Service, this Privacy Policy, and the Terms of Service are governed by Hong Kong law. Further, you are likely transferring your information to other countries, and you expressly consent to that transfer and consent to be governed by Hong Kong law for such purposes.

9. Compliance with Law

You agree not to use the HokuApps Service in a manner that would violate applicable laws protecting an individual’s privacy rights, health or financial data (e.g., with respect to the United States and as applicable, HIPAA and HITECH as well as the Gramm-Leach-Bliley Act and its implementing regulations).

10. Assignment

An assignment may occur as part of a merger or acquisitions, asset transfers, sales, or other change of control (as well as in a bankruptcy, including in an assignment for the benefit of creditors). In connection with the assignment of the Terms of Service and this Privacy Policy, HokuApps may also transfer or assign the information collected from its users.
